This website is operated by COCOAFAIR. By accessing or using our website and placing orders, you agree to these Terms of Service. These terms apply to customers in South Africa.
Article 1 — Use of the Online Store
By accepting these terms, you confirm that you are of legal age in South Africa, or that you have the consent of a parent or guardian. You agree not to use our products for any unlawful or unauthorised purpose.
Article 2 — General Conditions
We reserve the right to refuse service to anyone at any time. Card payment data is always encrypted during transmission. You agree not to reproduce or exploit any part of the website without our written permission.
Article 3 — Products and Information
Our products are food products. Please read the ingredient and allergen information on each product and refer to our Allergen Statement. We make every effort to display product information accurately, but we do not warrant that all content is error-free.
Article 4 — Pricing and Currency
All prices are displayed in South African Rand (ZAR) and include VAT where applicable. Prices may change at any time but will not change after an order has been confirmed.
Article 5 — Orders and Payment
Payment is due in full at checkout. Orders are processed and dispatched only after payment has been received. We reserve the right to refuse or cancel any order where we suspect fraud or unauthorised use.
Article 6 — Shipping and Delivery
Delivery is available within South Africa. Shipping costs, processing times, and delivery estimates are set out in our Shipping Policy.
Article 7 — Returns and Refunds
Returns and refunds are handled in accordance with our Refund and Returns Policy and your rights under the Consumer Protection Act 68 of 2008.
Article 8 — Tours and Experiences
Factory tours, tastings, and experience bookings are subject to the rescheduling and cancellation terms set out in our Refund and Returns Policy and Order Cancellation Policy.
Article 9 — Limitation of Liability
To the extent permitted by law, COCOAFAIR is not liable for any indirect or consequential loss arising from the use of our website or products. Nothing in these terms excludes liability that cannot lawfully be excluded.
Article 10 — Governing Law
These terms are governed by the laws of the Republic of South Africa.
